Sonoma Wine Rides – Terms and Conditions

1. Use of Site & Age Requirement

1.1. Eligibility: You must be at least 21 years of age to use this Platform or book any Services. By using this Site, you represent and warrant that you have the right, authority, and capacity to enter into these Terms. 1.2. Identification: A valid, physical government-issued photo ID is required for all passengers at the time of pickup. Jason’s Wine Tours LLC, dba Sonoma Wine Rides (the "Company") reserves the right to refuse service without refund if legal age cannot be verified.

2. Reservations, Payments & Responsibility

2.1. Group Accountability: The person making the reservation (the "Booker") is legally and financially responsible for the actions, conduct, and any damages caused by all participants included under their booking. The Booker agrees to assume all liability for their group. 2.2. Payment & Refunds: All sales are subject to the cancellation schedule outlined in Section 9. Unnecessary chargebacks are considered theft of services. In the event of a chargeback, Company reserves the right to recover the amount of the charge plus any merchant processing fees via collection agency or legal action. 2.3. Surcharges: Pickups outside our standard 20-mile radius (Fulton, CA) incur a custom surcharge based on current IRS mileage rates ($0.725/mi) and travel time ($50/hr), invoiced separately. 2.4. Itinerary & Substitutions: Company reserves the right to alter pickup windows or destinations due to traffic or winery availability. Company reserves the right to substitute vehicles of equal or greater capacity as needed.

3. Wait Time, Overtime & No-Show Policy

3.1. Private Tours: The tour clock begins at the scheduled start time. We provide a 15-minute grace period at the end of the tour. Excess time is billed at $30.00 per 15-minute increment. 3.2. Join-In Tours (Pickup): To ensure all guests stay on schedule, the van will wait at the designated pickup spot for a maximum of 10 minutes. 3.3. No-Show Policy: If you are not present after the 10-minute grace period, the tour will proceed. No-shows will not receive a refund of any kind. Guests may meet the group at the first winery at their own expense. 3.4. Join-In Tour Conclusion: Join-In Group Tours are event-based, not time-based. The tour concludes immediately following the third scheduled tasting experience. At that time, the driver will begin the return drop-off sequence. There is no option to remain at the final stop longer; all passengers must depart with the vehicle.

4. Vehicle Specifications & Damage Fees

4.1. Equipment: Tours are conducted in professional 15-passenger transit vans featuring forward-facing seating and a high-top roof design. 4.2. Security Hold: A $500 security hold (pre-authorization) will be placed on the credit card on file 24 hours prior to Private/Pairing tours. 4.3. Cleaning & Damage: A minimum $500 deep-cleaning fee applies for bodily fluids or excessive interior mess. A $50 fee applies per broken glass or significant upholstery spill. 4.4. Theft Disclaimer:Company is not responsible for items left in vehicles or stolen from parked cars.

5. Conduct, Safety & Alcohol Liability

5.1. Responsible Consumption: The simultaneous consumption of alcohol and the operation of a motor vehicle is strictly discouraged. 5.2. Minor Policy (Zero Tolerance): All participants must be 21+. Should any minor be caught consuming alcohol during the tour, the Company will immediately terminate the tour for the entire party without refund. 5.3. Prohibited Items: Smoking, vaping, and hard liquor are strictly prohibited inside all vehicles. 5.4. No Weapons Policy:All weapons are strictly prohibited on Sonoma Wine Rides vehicles. This includes firearms, knives, or explosives. Any guest found in possession of a weapon will be denied boarding or removed immediately without refund. 5.5. Winery Liability: Company is a transportation provider and is not liable for disputes or injuries occurring on third-party winery premises. 5.6. Driver Authority: The driver reserves the right to terminate service immediately, without refund, if any passenger becomes unruly or engages in illegal activity.

6. Intellectual Property & Media Release

6.1. Ownership: Company owns all right, title, and interest in and to the Platform, including logos, designs, and text. 6.2. Marketing Consent: By participating, you grant Company a royalty-free license to use your likeness (photo/video) for advertising. To opt-out, notify your driver before the tour begins.

7. Limitation of Liability & Indemnification

7.1. Liability Cap: IN NO EVENT SHALL COMPANY’S AGGREGATE LIABILITY EXCEED THE AMOUNTS ACTUALLY PAID BY YOU FOR THE SERVICE. 7.2. Indemnification: You agree to defend, indemnify, and hold Company harmless from all liabilities, claims, and expenses arising from your party's use of the Services or negligence.

8. Mandatory Arbitration & Governing Law

8.1. Dispute Resolution: All claims and disputes shall be resolved by binding arbitration through the American Arbitration Association (AAA). You waive your right to a jury trial or class action. 8.2. Governing Law: These Terms are governed by the laws of the State of California. Venue shall be in Sonoma County, CA.

9. Cancellation & Refund Policy

9.1. Non-Refundable Administrative Fee: All eligible refunds are subject to a 3% non-refundable administrative and processing fee. This fee covers non-recoverable merchant transaction costs incurred by the Company at the time of the original booking.

9.2. Join-In Group Tours:

• 48+ Hours Notice: Full refund of the booking total, minus the 3% administrative fee.

• Within 48 Hours: 100% non-refundable.

• Last-Minute Bookings: Any Join-In Group Tour booked within 48 hours of the scheduled start time is considered a final sale and is non-refundable at the time of purchase.

9.3. Private Tours & Food and Wine Pairing Tours:

• 14+ Days Notice: Full refund of the booking total, minus the 3% administrative fee.

• 8 to 14 Days Notice: 50% cancellation fee applies.

• 3 to 7 Days Notice: 75% cancellation fee applies.

• 2 Days (48 Hours) or Less Notice: 100% cancellation fee applies.

• Last-Minute Bookings: Any Private or Pairing tour booked within 48 hours of the scheduled start time is considered a final sale and is non-refundable at the time of purchase.

9.4. Weather & Force Majeure: Tours operate rain or shine. In the event the Company must cancel a tour due to safety concerns or winery closures, guests will be offered a full refund (inclusive of the 3% fee) or a rescheduled date.
